A Federal judge has ordered the owner of a Mattoon-based home healthcare service to pay $1.1 million in back pay and damages to 69 workers, according to the U.S. Department of Labor.
Earlier this month, U.S. District Court Judge Colin Bruce ordered Lee McDevitt, owner and operator of Midwest Home Healthcare, to pay the group of workers $562,389 in back wages and an equal amount in damages, according to the labor department.
Investigators reported McDevitt paid caregivers a daily rate, regardless of the number of hours they worked, leading to violations of minimum wage and overtime laws. Many of the caregivers worked 24-hour shifts, they said.
Following an investigation, the company began paying workers on an hourly basis and computing overtime in 2021, they said.
The caregivers worked in the Mattoon, Tuscola and Champaign area, authorities said.
